If herein described dog is a breeding
quality/show potential female, in addition to the purchase
price, Seller will receive ( ) pick(s) of litter, chosen
by the Seller, from the first litter(s) produced by
this bitch. Litters must be at least two live puppies. This
female will not be bred until after one (preferably two) heat
cycles and after one year of age, after a written preliminary
X-ray done by a licensed Veterinarian, at Buyers expense to a
stud dog that is mutually acceptable to both Buyer and Seller.
Pick puppy/puppies will bear the Von Wrinkles
kennel name. Buyer agrees to register litters produced under
this contract within 30 days of the whelping date (at the
expense of the Buyer). The pick will be made no sooner than
eight weeks and no later than 10 weeks of age of the litter,
at the home of the litter or via video recording, or a person
designated by Von Wrinkles Kennels. The Seller will pay costs
of shipping the pick(s) if necessary. The bitch must be bred
by the first heat cycle after receiving OFA certification at
two years of age. Buyer agrees to pay Von Wrinkles kennels
$1000 per puppy due if breeding does not begin within this
period, unless bitch is in active show campaigning, then both
Seller and Buyer will discuss a mutually acceptable breeding
date.
If this puppy is being sold as a pet, with
limited registration due to faults, it must be spayed or
neutered. Upon receiving Veterinarians proof of spay/neuter,
the Seller will release AKC registration paper.
Seller guarantees against hip dysplasia,
luxating patella’s and knees of herein described breed or show
quality dog up to the first mating or two years of age,
whichever comes first. (as deemed by the Orthopedic Foundation
of America-OFA). If any of these problems occur, upon
notification in writing, the Buyer may keep said dog, as a
"pet" and a deduction of "pet price" will be made from the
original purchase price. Buyer may sell said animal (upon
approval of Seller) free and clear and Seller agrees to credit
the Buyer the purchase price towards another puppy from
seller.
Von Wrinkles kennels is striving to
produce Shar-Pei that are free of entropion, through a careful
breeding program. Until the time in which the breed can claim
that it is entropion free, Von Wrinkles kennels does not
guarantee the eyes of the described dog, , as opinions of
entropion are only up to any vets interpetation
Absolutely no alterations or surgeries are to be done
without written permission of the Seller and a second
Veterinarian opinion is made. The seller, at her discretion,
may choose to replace a show quality pup, due to a necessary
entropion surgery.
Von Wrinkles kennels is striving to
produce Shar-Pei that are free of Amyloidosis through a
scrupulous breeding program. If said dog dies of Amyloidosis
(under the age of 5) every effort will be made to replace said
dog as soon as possible. When dog dies, regardless of cause of
death, a Red Congo Stain must be performed in an
autopsy of the dog as proof of Amyloidosis and provided to
Seller after results are received and before a replacement is
made.
The purchaser agrees and binds him/herself to
take good and reasonable care of the dog, feed and house the
dog properly, to control the dog on lead when off premises,
and properly avoid loss by theft, running away or otherwise,
and to promptly give or secure the best attention to the
physical welfare of the dog. If purchaser fails to do so,
seller has option and right to reclaim the dog at buyers
expense.
At no time during the terms of this contract,
will the Buyer transfer any ownership right of said dog to any
other party, unless Seller is notified ahead of time, in
writing. If notified and approved by Seller, the animal can be
placed with another person residing in the United States,
however the provisions of the original contract shall follow
the dog and all subsequent owners, transferees, etc....are
subject to and bound by the original contract.
If at any time the Buyer is unable to
keep above said puppy, the Buyer agrees to return the animal
to the Seller, immediately executing the AKC papers, with no
refund of the purchase price. Should the Buyer decide to sell
herein described dog for any reason, it is agreed that the
Seller will be given the first right of refusal at original
purchase price. If the Seller is unable to take the said puppy
back, the Seller will notify the Buyer in writing, and the
Buyer having been issued written permission, may at that time
sell, trade, or otherwise dispose of the above puppy.
It is agreed upon by the Buyer that the said
puppy or any puppies produced by the above puppy will not be
sold to any owner, employee, agent or individual connected
with a pet shop, or wholesaler of Chinese Shar-Pei. They will
not be donated or sold for auction or as a prize. They will
not be crossbred or used for fighting. In the event that the
Buyer is responsible for the sale of any of the aforementioned
Chinese Shar-Pei to the aforementioned organization or
individuals, the Breeder/Seller shall have recourse in the
courts for damages to their name and/or reputation in the
amount of $5000.00.
Any replacements that may have to occur because
of items in this contract, shall be made as soon as possible
under the discretion of the Seller. The replacements will be
made in as timely a manner as possible and not necessarily
from a current litter that is on the ground (pending prior
obligations).
A deposit of $_______is required to hold
said puppy from this litter. Said puppy shall be paid in full
before puppy can be shipped to or picked up by Buyer. All
deposits are non-refundable.
All advertising of this dog must include the
full correct registered name and the breeder of the dog.It is
stipulated by and between the Buyer and Seller that failure to
comply with the conditions of the Sales Agreement will result
in the Seller having the option of reclaiming herein described
dog. Buyer will forfeit all moneys paid on herein dog, and
shall sign over the registration papers immediately to the
Seller. Buyer will assume payment of all legal costs should a
situation occur as a result of failure to comply with this
contract.
This contract is a legal and binding
contract and shall be upheld under the laws of the state
of California. In witness whereof, the parties have
executed this agreement under their own free will and by their
signature herein set below agreed to above as stated.
